Home Loan processing fee-refund

I had applied for a Pre approved home loan form ING Vysya - Bangalore, the loan sanctioned does not cover the 85% of the property, I would like to withdraw this application rather I will not be availing the loan. This is a pre-approved loan and no other formalited were carried out by the bank

I request for a refund but there is no proper response from the officer/bank

Appreciate if you let me know if the charge of Rs.11, 236.00/- paid via Cheque #694927 is returned after deduction. Or may I move towards legal remedies, sine there is no repsonse from the sales manager/ representative of ING Vysya Bank. Thank you
