For Replace mobile phone

Dear sir, I have facing a problem from ebay seller mobileaccesory (Mr. Yogen Ved) I buy a mobile i9 from him on August, I recieve it on 10 August, after 3-4 days its speaker is not working, I call to seller mr yogen ved he told me to send the phone to him via courier and i do the same. after sending the phone I recieve back it on sep 25. I check the phone its speaker is working but very poor clarity or its microphone is very bad voice clarity also its charger is broken, So pls kindly told me what can I do with this phone, as per your rule any phone is replace within one week of purchasing but the seller is not replace the phone. please do the needful to me, can I re-send the phone to seller?...I think to never purchase any item to ebay (mobileaccesories) in future.
