Not giving the possession

Booked a flat in Itina Abha Project for Flat No- D 426 by paying an advance of INR 380, 000 in March. We were promised possession of the flat in June. We made further payments of INR 2, 470, 000 by end of April. Inspite of not getting the possession of the flat, we trusted the false promises made by the builder and registered our flat by paying INR 570, 000 on

5 Nov. Now, there has been no construction or any development of the flat since Feb (ever since, we paid advance). There seems to be no hope that we will get the possession of the flat soon.

We have already made a payment of 95% of the sum promised to the builder but there seems no hope that the builder will give possession of our flat. We took a loan for buying the house. We are paying an EMI of INR 33, 010 every month. We have unnecessarily paid an interest of approximately INR 176, 000 so far. There seems to be no progress in the building work and there seems to be no hope of getting our possession.

The flat purchased by us was 85% complete when we paid the advance and it is still in the same state.

Repeated requests and protests to them is taking us no where.
