Maintenance charged by the Builder

I purchased a flat two years back when construction was on going.

A year later I received a letter from builder saying “Your flat is ready for use and got Occupancy Certificate from TMC, so please make balance payment and take position of your flat” when I checked the flat, it was not completely ready, so I brought all pending works to the builder’s notice and asked to complete it first and then I will take position. Now after one year I took position of my flat even if some of the complaints are still not resolved. But the builder charged me the maintenance from the period of the notice i.e. whole one year for which the flat was not occupied by me.

Can builder charge maintenance for the period the flat was not occupied?
