Possession of softcopy of photograph

I am a student applying for various exams these days. So I got myself clicked for a passport size photograph. In one of the application form i need to send a softcopy of my photograph but the shopkeeper refuses to give me the soft copy of MY photograph.

Am I legally correct asking him for my photograph.
