Non Payment of Final Settlement

Dear Sir,

I was working with Maytas Infra Ltd. (co of SATYAM group) since 13th June. Suddenly after SATYAM scam, our management decided to cut off some employees and many of us were ordered to resign from the duties on 31st Jan. They commited to pay off all dues and notice pay in march end.

I decided not to resign and stayed with the company till company closed off (on 24th Feb) the office at Gandhinagar where i was single person to take care of all official acitvity. I was left with no work and place to attend the office. After my numerous calls and mail communication, I was sent with a Termination letter of 31st Jan 09 which later on after my communication was revised and I received a termination letter of 24th Feb from the HR Dept.

The company agreed to pay off the final dues in March and later on failed to settle and communicated me to pay off the dues in April and then May and now they say more 3 months.

I have mailed to Central Labour Commissioner office with a copy to MAYTAS officals about the same and my mail is also been forwarded to Gujarat region LC.

Later on I received a call from MAYTAS for settlement and I agreed to co-operate. But again they have charged me with different deductions which was never a part of my duty as I was only to authorise the labours for issue of safety helmets, shoes and machines for safety purpose and HR dept has deducted the amt from the payable Fund.

I am suppose to get the following due from my company

1. 2month Notice Pay (As per Letter of Appointment)

2. 10% Variable pay since increment was not paid monthly

3. LTA for 2008 - 09

4. Earned Leave

The company has teminated me with a reason of no work. I am sorting assistance from any source to get me the help.
