Cheating by merchant and delivering dubious product

I have purchased a Product (Geyser), which was purchased from a Standard Chartered Bank Credit Card. The merchant is using HDFC Bank EDC machine.

On 17/07/09, we purchased a Geyser from Metro Emart, at Lohar Chawl for Rs 7350/- (inclusive of installation charges). The merchant agreed for free home delivery at our residence in Thane. We got the delivery in a couple of days, but the product was delivered without the box, and the person told us that it was difficult to carry it, hence he got it without the box, and the warranty card and other details will be available with the dealer. We took his word and got the geyser installed. We then went to the dealer for the warranty card, and to check the box. He was giving us a warranty card of some other Geyser and a box in a dilapidated condition. On probing further, we found out that he has delivered some other product than what was booked by us.

After lengthy discussion, the dealer still didnt agree. We have already filed a dispute with Standard Chartered bank for the transaction. Now the merchant received a letter from HDFC Bank that the funds will be taken back from him. So he started negotiating with us, and agreed to deliver the product. He arranged for the correct product and informed us to visit him. When we went there, he started a different discussion, and now says, that we should bring back the geyser, which is installed in our house and take the new one. This was never discussed before. He merely wants us to run around for this. We told him that we will take this by ourself, he does not have to deliver it, but he will have to send his person to get it installed and take the old geyser.

The merchant has cheated us. Please do not purchase anything from Metro emart, Shreeji Bhavan, 62, Lohar Chawl, Mumbai-2. Tel : 22082594. He is a cheat and you should not waste your time and effort with such unethical people
