Subject: Complaint regarding non Submission of contribution vide PF code DL/6980 (Mode Attire Private Limited)

Dear Sir,

This is with reference to information received from RPFC-11/CPIO vide their letter No RO-Delhi/North/RTI-09/1076/1508 dated 08/05 received on 13th May along with a copy of the Annual Return filed by the company for the period 1999, a copy of the same is enclosed herewith for your reference. In this regard it shocked to notice from the information received that the company has not deposited the PF contribution of the employees after the annual return for the period 1999 and no action has been taken by this department to recover that amount.

I had submitted my PF withdrawal form along with the proofs of being an employee of the establishment attested through the gazetted officer as the company has closed, on 29th January but till date I did not receive my PF money. I only receive a letter from the PF authority vide letter no18790 dated 02/03 marked to the company for the attestation of the claim. Thereafter I filed a reply vide letter dated 17/03 on 09th April in response of the same, a copy of the same is also enclosed herewith for your reference. Later on when I did not receive any satisfactory reply I took the help of RTI. Now I got to know from the RTI vide their above letter that company has not deposited PF contribution since 2000. I would like to ask if the company has not deposited the contribution of the employees then whose fault is this and why should the employees suffer for the same. They only know that they have joined an organization where the PF is applicable and deductions are made accordingly and will get the same at the time of retirement or leaving the company. If the PF authorities are not able to recover that money from the employer then it is not going to be a fault of the employee and employee should not suffer for the same.

I would like to request you to kindly take necessary action in this regard and help me in getting my PF settlement done at the earliest.
