Not Repairing the handset

I bought a motorola handset Motorazer-II (V8) in January.

20 days back that is around 18th of july, its display suddenly disappeared and there was no light on the screen.

I went to the Motorola Repair Centre at Ghaziabad (UCOM Technologies, RDC, Raj Nagar). They took my handset and said that handset will go to the company for repair and that they will inform me about the status within 5 days.

After 5 days when they didn't call me, i called them up to inquire about the status of the handset. They people said and ask after 2 days. I called them after 2 days than they said ask after 3 days. I visited their place after three days than they said that handset is with us and u take it from us after 15 days as someone has taken that handset with him.

I complained this issue to motorola customer care and they said that they will call me back next day. But as of now i have not received any response.

Now, i want to file a case against them. Please advice how can i sue them.
