Refund/registering a case of cheating

I had applied for a 200 sq yard plot at PARK AVENUE proposed to be launched at Jaipur in March. As per the terms and condition mentioned in the application form I will get the allotment within 3 months time but till now noting has been alloted to me. After lot of inquaries I am able to get a refund cheque from the company which was returned by my bank with remark insufficient fund.

In the circumstance I wish to register a complaint or FIR against the company.
