Noc from builde

Hi one of my friend had booked a flat in 2004 in mumbai. He got a possession of the flat in Jan. Now due to deteriorating financial conditions he wants to sale the flat to his relatives, but the builder is not ready to give NOC.(as the society is not formed yet). Builder is demanding Rs.200 per sq.ft. Even the building has not got the OC yet.

What's the solution for this? How should my friend get the NOC from builder without becoming a prey for his excessive demand?
