Get a new scratch guard for my replaced handset

I went to the shopkeeper to get my mobile replaced as there was some problem with my mobile camera n they said ok it will b done on the coming thursday. but i want my scratch guard on the replaced mobile as the old 1 was having the same n it is a mistake of the company to give me a handset having problem. the cost of the scratch guard is 250 which i paid on the first day of buying the handset with it. now if it is going to get replaced so they must bare the cost of it or the com[pany shuld put a new 1 again on the replaced mobile.
