Phone error on purchase

Hi,

I have purchased a nokia 5800 from mobile store at MI road Jaipur on 25th September. When I bought the phone the key- guard was bit tight and I was told that with using it will loosen up. After one week of service when I did not loose up and I took it to the customer care to get this rectified and upgrade my phone. I was told that there is a water damage and it won’t be covered in warranty. My phone is still in new condition with the screed guard provided by Nokia not removed. I feel cheated as i have found out that nokia is dumping bad handset to india and i am one of its victim. i wil appreciate if you can please help me get a replacement... the serial no of my handset is 356910039389861.
