Denying warranty cover for defective earbud

On 14th september i purchased an Apple ipod shuffle 1GB (2nd generation)(serial no.4H825XQXYX6) from "Mobile Store, SaharaGanj Mall, Lucknow" (I have the sales receipt with me), approximatly from one and half month the sound output of the right speaker of the earbud is lower than the left one, when I contacted the local apple service center for repair (or replacement whatever needed), they rejected to accept the product on the ground that the rubber pad which attached just below the bud, has came out, I would like to mention that this part came out in the normal use of the product and it's not an accidental damage means it's a ' wear and tear ' sort of thing, moreover this part has nothing to do with the functioning of the product. Then I contacted the Apple customer care, after a long conversation with the customer care representative he advice me to talk to Customer Relation Officer, which finally told me that in case of wear and tear, the product cannot be covered under warranty. Means, the company is denying the service on the ground of a damage which arise with the normal use of product and which has nothing to do with the mentioned problem of the product.
