Not returning application fee/advance

We applied for an apartment with Bengal Peerless Housing Developmen​t Company Limited in February/ March for Type D Avidipta Housing Complex. They held the lottery in May/June and in July we were emailed that we did not win the lottery and the wanted my bank details to submit the information. However, its August and they have not sent me the money. Whenver I call and they 'pick up' the phone, (which they occassionally do) they say that it will be sent in a few days and they have been saying this for the last few weeks. I hear that applicants from Kolkata who did not win already got their application money but I do not know about NRIs. I live in NJ, USA so not sure if the other NRIs are facing the same treatment. Now I am getting worried because they do not respond to my emails. Is there any way to get back the money?
