Flat Purchase
Token Amount given to not return

Hi, I was selected one 2bhk resale Flat in Kothrud in Jan and given token amt 100, 000 (cheque) Rs to milind salunkhe (Owner of the Flat) amount.

After 2 days i come to know that the flat is in Very Bad Condition and huge leakage in bellow flat, so i have cancel the flat and ask to Salunkhe to return my 100, 000 Rs back . he given me 50, 000 Rs back but Remaining 50, 000 Rs is Still Pending with Him, now he refuse to give my 50, 000 Rs back to me.

I have no Document Except Cheque Number with me.

Can i get my Money back from him? If yes How? Any Legal process?
