VAT dispute on residential property

Bought brand new residential flat from Giridhar Creations (office address, 10 Pentagon Parvati Pune) a builder in Pune Flat registered in 04-Aug and got possession in Nov, while taking possession builder had asked for anticipated VAT amount on property (one lakh rupees) and mentioned that there is dispute going on whether VAT is applicable on said property or not in the court with the state government

I had to pay money to builder because he was not giving me possession of my flat.

Please help here whether what builder said is right, do I really need to pay VAT.
