Khata not arranged as per sale deed promise

I have purchased a flat in Gopalan Jewels, Kanakapura Main road, Bangalore -560062 and as per sale deed, the builder Gopalan Constructions, has to arrange Khata for which they have collected the payment too and till today it is not done. The flat was handed over during 2007 and roughly 5 years are over! Because of this problem, we are unable to sell the flat for emergency purpose. Kindly help me out... Thanks. Dr. S.Sridha
