Cancelation of flat

I booked a flat L404 in homes 121 in nov an paid booking amount Rs 1 lac. After 3 week we found that this property is not suitable for us. We asked property dealer Mr. Ashish to cancel the booking. Property dealer did not cancel the booking and haven’t returned money. I keep calling him for several months but he didn’t returned my money.

finally I submitted my cancelation papers in builders office one and half month ago, now builder is asking for NOC from property dealer.

Is this necessary to get a 'No Objection Certificate' from the property dealer thru which I booked the flat whereas that dealer is not giving NOC. Is it a valid requirement? Why this is required at all?
