How to file a case against Home Builde

Hi,

I want to file a case and take legal action against my home builder,

We have a agreement signed with the builder and he didn't complete the construction even 10 months for 830 Sq ft, still builder has lots of pending work

payment has been done through the bank a/c and he is still demanding more money before the completion of the work.

planing and work quality is worst and not as per the expectation and we have to follow up most of the time since the engineer doesn't come to site often to monitor the work progress

I want to terminate the contract and i fear that the builder won't return the money for the uncompleted work and i want to register a case in the court

Please let me know how to go about it, Please Help.
