I would like to bring to your kind knowledge the following facts and circumstances for necessary adjudication at your end.

I had submitted an application in December for purchasing House No. P-23 of Defendant No. 1 above against notification made by secretary, RECOL Cooperative Housing Society inviting application from amongst the employees of NIT (R.E. College) Durgapur.

The selling and purchasing of House situated at RECOL cooperative housing society is done through society as per their standing by- laws.

In view of above the cooperative authority made a lottery amongst all the eight applications so received within the stipulated time for determination of priority list. My position in the list appeared to be second, but having no response from first party I was considered to be first.

Accordingly I was advised by the cooperative authority to settle the price of the house with the defendant no. 1 above. In compliance with their advice I approached to Smt. Mira Dutta alongwith two hon’ble member of the cooperative and settled the price of house at Rs. 23 Lakhs

(Twenty three lakhs only).

On submission of consent letter before cooperative authority Smt. Mira Dutta (Defendant No. 1) received Rs. 7 lakhs (Seven lakhs) as advance from me followed by receipt and formal agreement executed on N.J. stamp.

After lapse of about one year neither Defendant No. 1 nor Defendant No. 2 above are taking any positive action to enable me to purchase the house as desired.

Having several approached to Defendant No. 1 and Defendant No. 2, it is observed that they are neglecting and avoiding to settle the matter in my favour.

Under the circumstances I am sustaining great moneytory loss and mental tension.
