Kaka Properties are frauds

I booked a house in Geeta nagar, phase 7, 103, through Ashish Kanakia, Kaka properties. He misinformed that there was no OC on the house. He took 2.5lakhs through cheque in the owners name Sanjay Jha as advance booking/stamp duty/token money. I had sanctioned loan from IDBI bank for 19lakhs. But still my loan got rejected because of no OC clearance. So Ashish assured me will arrange a loan without OC through nationalize banks. After 5 mnths now they both refuse to pay the money back saying they have incurred losses because of the delay in my loan.

i have all the receipts and cheque transanction, but Mira road police refuse to file FIR saying they dont entertain such cases.
