Use of substandard material by Mr. Peshave

Mr Mandar Peshave was appointed by me to construct an additional room and enclose the existing verandah in my bunglow in Pune. He was also asked to relay the drive way, and paint the house He was entrusted to do this work in my absence as I live and work abroad. He took an unusually long time of about 3 years for the civil work which should have been completed in in a few months. Mr Peshave has used substandard material in 1. the internal paint which has already started cracking (within a year and a half. 2. The tiles on the drive way which was newly laid out were not able to withstand the wear and tear of even one monsoon. Further to this, he used a different variety of tiles and not the varitety that was chosen by us. During my present visit, I have had to get the tiles replaced at a staggering cost of cost of 1.2 laks. 3. The sliding glass aluminium window unit that has been fitted in is defective. This was also pointed out to him and he was asked to replace it. But he did not do this. The usual modus operandi was that over the last three years, when we were here on home leave, |Mr|Peshave would delay the civil work under varying excuses, and would pretend to hasten things just a few days before our departure from here. The end result is that we have paid in excess for a relatively small work which was unduly delayed under various excuses. The delay in completion of the project i am sure has escalated the cost considerably. Adding insult to injury is the fact that defective work has been done using subsatndrad material. I requested Mr Peshave telephonically to visit the premises so that I could point out the defects to him, but as expected, he has not appeared, though he pomised to do so.

My wife and I are senior citizens, and not being familiar with the buidling profession and its technology, we depended upon Mr Peshave's expertise as an architect to see us through this project. Instead, we feel that we have been exploited, and advantage has been taken of the trust bestowed by us on him, and our absence from the site as i work abroad, and visist here in pune only during certain times of the year for short periods of time. At no time was there a delay in his payments. As all payments were made by cheques, the record is available in my bank as well as MrPeshave's bank.

My greviences against the concerned individual should be redressed and Mr Peshave must be made to refund the cost of new tiles on the driveway and the court yard (Rs 1.95 laks); the cost of the aluminium sliding window unit (Rs 25000), the cost of the internal paint (Rs 1.86laks) as a minmum penalty..
