Cancelled the home agreement 2 years back but have not got the money back

1.Myself Soumen Maji, had made an agreement on 16th April’2008 to purchase a flat at 3rd floor (Flat No:3C), 6 R.G Avenue, kolkata:700028, West Bengal and paid Rs:1, 27, 000.00 (15% of the total flat valuation) Rs:10, 000.00 (Electricity charge)

2.Due to have some financial problem I cancelled the same on October’2008 and submitted a cancellation letter by hand but with no response.

3.Having no response from long time I send two registered official cancellation letter on 8th November’2009 to his personal home address as well as to his office address (Please note the cancellation letter which was send to his official address returned back to me and the letter which was addressed to his home delivered successfully). Each and every time when I am calling to his cell number, he is making some false commitment and avoiding to pay back my amount.

4.Its 1.5 year over since my cancellation I have not received my money back, paid by me.
