Maintenance charges

Hello,

I have been staying here at my own flat in Thane since more than two and a half years. I had purchased the flat in ready possession, I had paid one year's maintenance in advance to the builder of which I have the receipts and other diocuments. Now there is a situation where my housing society has not got the maintenance money from the builder (which I paid at time of purchase) and socty keeps on blacklisting me on the defaulters list of maintenance charges. However after 1 yr I have been regularly paying the charges still the socty needs the money which I had paid to builder. The reason is, while I purchased the flat society was already formed and their say is I should have given the money to them not builder. However, I was not at all aware of this as the charges werer clubbed by builder in his breakup sheet along with stamp duty registration charges.

Other thing is the flat was already 2 years old when I purchased it in ready possession, the scoiety now clubs the bill for those two years as well when I had not owned it.

The builder now dismisses my appeal to give the money back to socty saying he has some case in court with society where he has to get money back from them and society says builders is telling lies and I have to get teh money from him. In this hussle I'm suffered, as unnecessary I have to pay the interest on the pending amount which actually is not my fault.

Moreover, society says, that the builder has returened the money to some of the residents so I should also get it from him. I have approached the builder more than 10 times now, but he has refused me citing the court case every time as mentioend above.

Please let me know what should I do in this case. I'm already paying the interest every month which is not my mistake.
