Delay Handing Ove

I have booked an apartment in a project called ORCHID ANJANAM-Guruvayoor. While booking the apartment they have given me a schedule of delivering the project in 14 Months, however the project completion is delayed by more than 2 years now, and we still do not see any sign of completing the project.

whenever I approach Mr. Sarvanath (Managing Director) for date of delivery he keep me flimsy excuses but no firm commitment. In case of delay, the builder is liable pay demurrages’ (for the period of delay) as there has been a breach of contract. The builder problems can’t justify delay.

I have many communication with Mr. Sarvanath and his statement is that the apartment is ready and I have to pay the remaining 5% of payment which has to be paid at the time of hand over. As per basic principle an apartment is ready when it has completed all construction work and ready to live in with all utilities available. And when I inspected the apartment as per his advise I found the agreed facilities were not provided.

Mr, NK Sudheer who is associated with congress politics is the chairman of the project. Being a congress man I expect him to respond to our concern and make necessary arrangement to complete the project. I are paying huge interest to our bankers but no returns.
