Company charging extra

Dear sir

i am baldev and i am a defence officer. i had booked a independent villa in OMAXE CITY in lucknow in apr 06 when i made initial payment of 10%(around 1, 64000).i was to make payment of 85 %(around 13, 95, 000) but that time omaxe had not procured the clear title to land and therefore i was not given loan by my organisation and when i spoke to the officials in omaxe at lucknow they told me that the problem is from there side and hence once the procure the clear title they will give me and also that i will not be charged any interest cost.i got the letter in feb 07 and i made the payment in mar 07 and now when the posession letter is sent to me it showed interst cost of 2, 59, 000 and on speaking they reduced it to 1, 02, 000.

the company was also supposed to pay rebate at the cost of rs 5 per sq ft/month which they havent adjusted.

i want to know is it justified and should i pay this unjustified cost.what is the legal course of action do i have and how should i go about it
