Asknig for money which is not in line with terms agreed

I visited the site on September 10 to inspect the flat for which I have entered into flat buyers agreement with your company on receiving letter to take possession. On my visit I noted that the said flat is not fit for handing over possession and it would take your company atleast a month to make it fit for handing over possession. This I have also mentioned to your representative at the site Mr. Saurabh. Please note that as per terms of Annexure-II of flat buyers agreement the balance 5% of total consideration is required to be paid by me on possession. i have requested to kindly get the flat completed for handing over possession to me and I will make the payment then but simlpy say pay 5% in advance otherwise we will charge interest also.

Since I was unable to establish contact with any of senior offical of the company and lower level people say that if i do not pay 5% in advance flat will never be given.

we have visted 5 times to their office and are able to meet only lower lever staff and no senior people wants us to meet and simlpy say pay 5% in advance otherwise we will charge interest also.
