Not Refunding the booking amount

I've booked a flat at Genex Tower Barrackpore on Feb. The project had been started earlier but suddenly it got stopped because of some problems with the Government. There is no work going for past several months. In this situation they have not completed any agreement with me as well. Since this january-12 I've given a hand written letter for refunding back of my booking money and the agent confirmed they will get me the full amount back within Mar-12. But still as of now, they continue saying that the refund is in process and the final date could not be given.

Pls suggest is there any way I can go to the consumer court to get my amount back?
