Fraud in flat booking & aggreement

Hi,

I booked a flat in My liberty Homes in Jagatpura. Builder rohit suri, Amay home Services, Ltd.

Initially paid 1 lac to them. Rest 7 lac IDBI granted loan. according to tripartite agggreement builder have to pay interest or pre EMI till possession given.

Now IDBI contacted & said builder fails to pay interest on loan disburse amount, & having dues.

pls suggest couser of action.
