Forfeiture of booking amount

We had booked a flat with Ansal API in March end 2011 and paid Rs 5.36 lakhs as booking amount. We received the agreement copy for the same only after 2 months. And as soon as we received the agreement we did not wish to agree for the terms and conditions as the agreement was one sided agreement, hence requested for the concellation that is on 31st May. But Ansal sends us a letter in July stating that since they did not receive further payments they cancel the allotment and forfeite the booking amount.

We have not signed any agreement with them. How can they forfeit the amount???
