Illegal use of mobile / poor service!

Tata indicom has been my worst experience till date. I ordered for a cell phone which was supposed to be delivered to me 2 months back. For initial couple of days i received phone calls from ur customer care dept mentioning that i will recieve a cell phone in one or two days time which actually never happened and now i have been receiving bills on a regular monthly basis for April 07 and May 07 which clearly indicates that somebody is using that phone. That somebody cannot be anybody but i m pretty sure that, that person belongs to company an is aware of all the loopholes. The number reflecting on the bill is 9212549865 which is obviously not been used by me. When i received the first bill in April 07, i went to Tataindicom office in okhla, Newdelhi-india and requested to cancel the number. They committed that in few working hours this number will be disconnected which actually never happened and the number is still going on strongly. My concern is not the payment of bill coz if i m not using it nobody can make me pay for it. My concern is that if this number is being used for illegal purposes it may cause trouble for me as it is issue in my name.
