CHARGING MISC CHARGES

I went to have a lunch along with my friends in Dhaba Express located at Greams Road in chennai. After finished our lunch, we asked for a bill. The total bill amount was Rs. 769/-. There is a charge called MISC Charges of Rs. 72/-(10.3% of the actual bill) charging in that bill. If it is a service tax why are they mentioning it as MISC charge. I dont know wheather it'll pay back to our governmant or not. Need a strict action against them.
