Spare part of honda eterno scoote

I have purchased honda eterno scooter on 12/3/09 from om sai honda, malad west mumbai.i have also paid for companys extended warranty up to 12/03.i regurlarly service my scooter from om sai honda service center at kandivli, mumbai.

on my last service on 09/11/10 i had told service engg.that my scooter gets pooled on one side some times, & after inspection he told me that stearing cone set is to be replaced, as per his advice i have ordered the same with their spare dept on 09/11/10.but till today they have not received that part & they say that company is not providing the spare parts. who will be responsible if i meet an acident due to defective part? if company has stopped production of eterno scooter & they find difficult to provide spares with in 2 years of scooter manufacturing i request you to give me an offer to exchange my scooter with new product or make arrangement for spares required.
