Subject: - Legal Notice

Sir,

1. That myself is owner of Tata Indigo eCS Car no HP-12D 4077 Chasis no. MAT601462AWJ41279, which met with an accident and I, leave the car with you for repair work, you being authorized dealer of M/s Tata Motors Ltd.

2. That after repair work my car was handed over to me by Mr. Daulat Ram, after obtaining my signatures on some papers and he also charged Rs. 4096/- from me as depreciation amount as my car was insured through M/s Tata Motors under cashless claim scheme. Tax Invoice no. JoshiA-CH-1011-01330 dt. 27-11 was issued in this respect.

3. That at the time of handing over the car to you, I was assured by you that you will replace the damaged parts of the car, as it was new car.

4. That after 2-3 days of driving the car I was of the impression that very poor quality work has been carried by you as the car started unusual noises and paint of car was also damaged and you instead of changing the damaged parts repaired the old parts and fixed the same. It was very surprising after going through the invoice, that you have charged the money for new parts from me/ insurer of the vehicle. You also charged excess money from me on a/c of depreciation amount. When I, came to know about the entire episode I, contacted Mr. Daulat Ram and lodged my complaint with him about fraud played with me, who tried to convince me with lame excuses.

5. That your act to fit repaired parts in place of new parts and to charge money for new parts is certainly fraud and criminal breach of trust with the customer and it also comes under the purview of unfair trade practices. The services rendered by you are deficient.

So through this notice I call upon you to replace the repaired parts with the new parts and also to repaint the damaged paint parts of the car and to pay Rs. 200, 000/- on account of mental agony, harassment and damages, with in 7 days from the receipt of this notice failing which I, shall be constrained to initiate legal proceedings against you in the competent court of law and in that event you shall be liable for all the expenses incurred or to be incurred while maintaining the same. Take further notice I, will forward this notice to Tata motors ltd. for inquiry and necessary action and to appoint company engineer to get the car inspected.
