Complaint of Fraudulent Behavior against Mr. Madan Lamba & Mr. Chetan Lamba

I approached to purchase second hand car from Mr. Madan Lamba & Mr. Chetan Lamba on dated 24th Dec. Following are the details of Car purchased from above mentioned people.

Vehicle Registration Number: MH01 GA 7000 & Make: Mercedes Benz 200K AT

We closed the deal at 6, 70, 000 rupees and I paid the amount in cash to Mr. Chetan Lamba on 24th Dec who came to Pune at my residence to give delivery of Car. Very second day I have to replace the battery of Car as it was dead and car was delivered making jump start of engine. I replaced battery and renewed insurance at additional cost of 32, 000.

However after driving the car for one more day I realized that there were so many defects in the car which I was never told during deal finalization. Mr. Chetan kept on telling that vehicle does not have any defects and it is perfectly right and I can take his words as guarantee.

I gave car to Mercedes Authorized showroom (Ms B.U.Bhandari, Pune) for detailed inspection of Car and found that all the parts of car are in bad condition and needs urgent replacements. Cost of repair and replacement is around 300, 000 rupees for the car. When I asked this from Mr. Chetan & Mr. Madan that why he did not told about all these defects before making deal. He does not have any reply on that and asked me to send the car for repairs at his place.

After several rounds of discussion I asked him to take back car and return the deal amount so I delivered the car back at his shop in chembur on 4th Jan. Mr. Madan & Mr. Chetan demanded more 20, 000 rupees to do some immd. repairs so car can be displayed for sale at his shop. Considering the time spent on car and urgency to sale I given him more 20 thousand rupees on 7th Mar.

But after several follow up and calls Mr. Madan & Mr. Chetan neither repaired the car nor returned my money back.

I visited them on 2nd April to check the status of Car, and during visit I met Mr. Chetan & Mr. Madan and I was again given assurance that they will repair and sell the car within 07 days.

As of Today Mr. Madan & Mr. Chetan has spent almost 4 months and they did not returned my money back.

I request you to please consider these facts and take appropriate legal action against Mr. Madan Lamba & Mr. Chetan Lamba.
