Replacement of handset

I had bought NOKIA handset Model N 73 bearing sl. no. 356406014003338 on 14-08-07. The handset was getting hanged frequently. So I deposited my headset to HCL Infosystems Ltd., 37 Shakespearte Sarani, Kolkata on in the month of September'07. After several follow up I was told that handset is beyond repair and it will be replaced. In the month of October, I received SMS from HCL, informing that set is ready to be picked up. M peon collected it but to my horror, I was handed over an old handset bearing sl. no. 353641010906068, though the model was same N73. This set was carrying rust all over the keypad and scratched over the screen. For obvious reasons, this handset was not acceptable to me, as my handset was brand new. I resubmitted the old handset to HCL once again with an assurance that I will get new set. They have issued their job sheet No. 6100225170 dated 29-10-07. But after several follow up I was that that I have no choice but to accept the old set only which is in defective condition. I have not collected the old set from HCL and it's still lying with them.
