Hanging mobile

I bought sony yendo mobile last month and it is a touch phone and i started using the mobile and it started hanging and i cant even switch off the mobile, i have to remove the battery.and i spoke with sales guy from the store where i bought and they says the s/w version has to be updated.then if the sony people finds the problem why they selling the product, why cant they bann it.and they says i have to send it to repair center, and iam i lokking like a stupid to send a mobile in one hour (usage) to a service center iam filing a case againist sony regard this in the consumer court.
