Nokia 1200 mob. Faulty since purchase

Sir i purchase this mob. On 19.09. 2008. My model is 1200 and imei no. Is 355736022768352. My mob.problem is switch on switch of and then switch of complaitly. I give it to nokiacare center many times but problem is not cured by them.in this prosess my mobi. Warranty expired. Now nokiacare says the phonework is charjeble. I told them phone since one year in ur center comes regurly what u do with him when problem remain same.then they send it to delhi. I want replacement but they wont. What should i do now? Should i go to consumar court? Pls help.
