Used Phone Sold

I bought a new handset "Samsung Galaxy S" paying more than Rs. 28, 000 and when I opened the sealed box, it was a used piece. There were contacts, sms, and emails of previous owner of the phone.

I already showed it to the Floor Manager, but was in a hurry. She promised to follow up and send me and the vendor an email asap. There has been no communication ever since, and I have not received any email. She in returned just apologized, and gave 2 gifts (a shit "not for sale" bluetooth headset, and a useless speaker set).

I had to rush to Bangalore for business visit, and when I came back she still didn't follow up. I am right now operating a used phone which I am not even sure how much old it is. I have lost the trust of buying electronics from Hypercity and I want a new model (sealed) to be provided in exchange of this old model. I have the bill details and card statement with me.
