Hanging problem and battery backup is nit prope

I have purchased a nokia N81on 18.03. it has a problem of hanging and battery backup is also not proper for 3 months. When i contacted on 13.03.2010 to the service centre, they said that it has not under the warranty cover and they will charge the price for repairing because the problem had come due to water. I think this is not the proper answer as the Service centre can give the same answer for any problem and there is no meaning of warranty. and it will also damage the image of nokia.
