Giving me a old (used) mobile set in place of my mobile set

I bought a new mobile phone nokia c6 from agra at 13-02.

Now I am in doing job kolkata. One day (18-06) I was making a call and my cell got dead suddenly. It was not getting switch on.

I went to nokia care. And they told me to submit the phone for two three days. And at 21-06 they called me and told that we are sending your mobile phone to gurgaon for repairing. Then they called me and told that problem in your mobile phone is not repairable. So we are proving you an another mobile phone with same model. When I go there they provide me a used mobile phone. And there were scratches on the phone also.

So I refused to take the used mobile. And told them to provide me a new set or my own mobile set.

Then they told me that this is the company policy u have to take this set.
