Mobile at Service center for 2 months

Hi,

I bought a C6-01 mobile on 28th may and used it around a month. In july 1st week, i had some problem and gave it to service center. From then on, it's with nokia service center (in between i got the mobile back, as they said it's working fine, but it dint and i gave it back the mobile to them within 2 days of getting it from them). They have asked me to get my mobile back today (25 Aug) (replacement mobile). I have asked them to extend my warranty, as they had my mobile with them close to 2 months. If they dont extend the warranty, should i take this to consumer court? Please help me on this.
