Phone gets heat while using

I have purchased a nokia E71 on 26/10.I really unsatisfied. The phone gets heated up while using. First time I have given it to nokia care. They kept it for 2days but no changes. I have requested my shopkeeper for replacement, he kept the phone for one month and assured me phone will exchange and new handset will be given. After one month he returned the handset as it is. I don't have time to run after the nokia people. Now one button of keypad stops working when I visited nokia care they told me it happened because I have dropped my phone into water which absolutely wrong. They told me it will not cover under warranty. I need to pay for repairing. The major problem the phone gets heat every time while talking and i am not able to bear heat.i am using my head set to use the phone. Please help as the handset is costly one.
