Web Design Scam

Mr. Ashok Kumar and his company has managed to scam from me more than 2000 USD for a website that they never finished. They presented the company from elance.com a reputable website for it contractors to offer their services. Then the start the project, but never finished. They pushed me into pay them the milestones of payment and promising that they will finish the website but actually the never finish it.

I have been batteling with them for more than a year, but I don't know how to take legal actions against them in India. If anyone has any suggestions I will appreciate their advice.
