Faulty battery and Problematic self start

I purchased a Bajaj XCD 125cc from Shri Krishna Bajaj auto agency, Station Road Mainpuri, U.P.-205001. soon after the purchase the self start of the bike started troubling. on servicing i was told that, " the battery is discharged". so the battery was charged by the local dealer, twice. but the problem continued. on the third service, i was told that the battery is defective and needs to be replaced and i was referred to the local battery EXIDE dealer.

The battery dealer is not willing to replace the battery, Moreover, he says that they can change the battery only after the claim is approved by the company. He says that the battery has to be sent to the manufacturer along with the claim and until he gets orders from the company, which according to him will take atleast 20 days, he cannot carry out any replacement.

The only mode of daily conveyance that I have is this bike and leaving the battery without a replacement is practically impossible for me and the dealer is not ready to help.
