Debiting my credit card without sending ordered material

The ITBC offered Jeeves and Wooster DVDs in their August issue.

I placed an order for eleven DVDs and my credit card was charged Rs 2640 for the items on 6-Sep.

I did not receive the material. On enquiry in end September and again early October I was promised delivery 'in two weeks' each time. On enquiry on Nov 10 I was informed that the items were out of stock.

Yet in the Nov 10 and 17 issues of India Today the same Group is advertising for the same products!

I am yet to get refund of the amount illegally charged to my Credit card.

How can the party charge my credit card for a product they claim is out of stock?
