Booking amount Refund

I booked a 2 BHK apt in Megapolis in Pune with Kumar Properties in August. The builder later called me and informed me that the tower I booked the flat in would be delayed and I should shift my booking to a new tower, which I denied and asked for refund. There is no agreement done b/w me and builder and not the builder is not returning the money - 4L.

I had borrowed this money from market at high interest cost, and I am also not sure about my job.

Pls advise how shall I proceed, since the builder does not pick up my calls and answer emails
