Refund money - Pre launch

Dear Sir,

I had booked a 160 square yard plot in July with MTech Builder. Ashram, Delhi at their upcoming project at Bhiwadi Cameliia Garden - 2 with a view to build my house. I had paid a booking amount of Rs. 1, 60, 000/- in Sept and was assured by their dealer, that within 6-8 months I would get the allotment after the Rajasthan Govt. gave its approval of 90-B--i.e. the license, to the builder. However, MTech Builder failed to obtain the requisite license and the delay is already over two year.

Earlier in Feb when I used to call their staff, there were a lot of excuses like we are not giving any refunds as there is no money, M.D. has refused refunds. Later their staff blocked all communications&they did not pick up their mobile phones (Nos. 9910340004, 9910897116, 9910398567 etc.) despite my having called them 50 to 60 times in the last one month of course they never got back to my missed calls. Since mid- Jan they have either cooked up cock and bull stories so as not to pay up the refund.

This builder is a cheat for the following reasons:

1. Pre-launches are banned by the Govt but he collected money from the public which was illegal. Frankly I was taken in by the high pressure advertisements in dailies like the Times of India and Hindustan Times which appeared continuously and frequently for months. When I booked it I admit I didnt even know there was a ban on these pre-launches. Later I was surprised how the Government was allowing this hoodwinking by such builders.

2. The land that they were claiming have been aquirred was false. A media report was shown on TV which clearly said that they have no land as such. Though when contacted they say its rumours and competitores are trying to false their image.

3. He has been fooling us for over two year that the license is just a month or two away. In Oct he admitted the delay and offered to transfer our money to his other projects But when I approached them to do the same they again giving explanations and not doing the stuff.

4. People who managed to get the refund cheque are struggling to actually get the money because they give the cheque for 3-4 months date which gets bounce. So simply a way to make fool and delay things.

5. No bank is granting loan on this builder projects.
