Dear sir,

I am flat owner in registered co-operative housing society in the district of navsari, gujarat state. The share certificates issued to me in the year May'2000. During this time the prevailing law didn't insisting to carry out dastavej and thereby preventing to pay stamp duty thereof.

The builder who is promoter of society is still secretary of the society.

Now i want to sale my house.

To enter the name in local city survey, i have contacted frequently to local city survey office but they refuse to accept my application to enter the name in city survey. The reason they specified is, i have to carry out dastavej at prevailing rate of jantri with the builder / promoter and thenonly they accept my application.

I am confused as the issue of share certificate in the year restrict to execute dastavej, and thereby to pay stam duty.

You are requested to kindly guide me with relevant law prevailing in this connection.

Also the builder has no submitted any expenses details, not conducting any AGM, and has stopped to expense for the monthly maintenance of the society.

Earlier the builder was carrying out maintenance and subsequently, on siple paper he sent us the deposits vs expenses statement reflecting no balance and stopped maintenance of the society.

Also the builder has registered area of terrace in his wife's name and given the said are on leas to idea cellular and creted the nuisance in the society by installing huge structure on terrace alongwith DG set. After our quarrel and fights, he has remoed the said structure after 2 years. We have asked the builder to deposit monthly rent received from iea cellular to society but all the money were kept by him only.

You suggest the way to suit the builder.
